Risk Disclosure

According to Approval Decision No. 488/QĐ-UBCK dated 11 June 2015 issued by the State Securities Commission of Vietnam, Techcom Securities Joint Stock Company (TCBS) has been authorized to provide online trading services. TCBS continuously upgrades and enhances its online trading system to best meet clients’ requirements and to minimize potential risks to the greatest extent possible.

1. Advantages of the Service: The online trading service provides clients with convenience and flexibility in executing transactions, shortens processing time for each transaction, and thereby enables clients to save time and costs.

2. The use of electronic trading services inherently involves certain risks, which may arise from system errors attributable to TCBS, the client, or any third party. By using the electronic trading services, the client acknowledges and agrees to assume all risks, losses, and any other damages that may arise from system errors, third-party faults, or the client’s own actions or operations affecting the use of such services. The client confirms that they have read, clearly understood, and accepted full responsibility for all risks that may arise from the use of the electronic trading services, including but not limited to the following:

  1. Hardware or software failures, or systems not operating in accordance with their designed functions due to floods, fires, natural disasters, electrical faults, natural deterioration, acts of vandalism, or fraudulent human conduct, which may result in trading orders not being executed or being executed incorrectly compared to the original instructions;
  2. Errors occurring in the information systems between TCBS and the relevant Stock Exchange during a trading session; securities price boards and other securities-related information may contain inaccuracies or discrepancies, or clients may be unable to access the TCBS system;
  3. Failures of TCBS’s computer systems due to power outages, cyberattacks, virus infections, or other unforeseen events that may prevent the processing or execution of clients’ online transactions;
  4. Failures, viruses, cyber-attacks, or security breaches affecting the Client’s computer system or device, resulting in unauthorized disclosure or theft of transaction-related information (including login credentials, trading passwords, authentication devices, telephone/mobile numbers, and other identification factors, if any), or unauthorized use of the Client’s account by third parties);
  5. Transactions executed contrary to the Client’s intention due to the Client’s insufficient understanding of the trading methods registered with TCBS or errors in operating devices (e.g., incorrect data entry, typographical errors, or other input mistakes);
  6. Online transactions submitted by the Client shall be automatically processed upon receipt by TCBS’s system. TCBS shall deem all online transactions transmitted to the Company to have been duly authorized and executed by the Client. Accordingly, any claims that such transactions were mistaken or erroneous shall not be accepted. The Client shall bear full responsibility for any resulting losses or damages.

3. TCBS shall not be liable for any loss or damage arising from the Client’s disclosure of login credentials, trading passwords, or other identification factors (if any). In the event such information is disclosed, or the Client becomes aware of any unauthorized use of his/her login credentials or account, the Client must immediately notify TCBS to suspend transactions and implement appropriate remedial measures.

4. TCBS is committed to providing Clients with high-quality services and to minimizing technical risks to the fullest extent possible. TCBS sincerely appreciates Clients’ trust in and continued use of its online trading services.

5. TCBS automatically records detailed access information when users visit the website at https://tcinvest.tcbs.com.vn/ or access the TCInvest application, including the user’s IP address, browser type, date, and time of access. TCBS also collects information relating to the computer or mobile device (“Device”) used to access the website or application, such as operating system, device model name, configuration, and system settings.
